What if the item is in Public Domain?

MUSIC, TEXT AND ART!! All FREE, All the TIME! COPY ALL YOU WANT!! Ok.... What's the catch? The neat thing about public domain is... there is no catch. Books, songs, movies and/or artwork that are in the public domain are not protected by intellectual property laws (trademark, copyright, or even patent laws)
Public Domain = FREE, not requiring Permission!

Three factors are the leading causes of items being designated "in the Public Domain."

  • Works published in the United States before 1923 and/or works published before 1964 and copyright was not renewed. (Renewal was a requirement for works published before 1978.)
  • Special cases where items were published before March 1, 1989 and without copyright notice in the United States. (After March 1, 1989 copyright is granted automatically even without notice.)
  • The owner gives them to the public without copyright protection.

There are rules establishing the public domain status for each of of the different types of media (print, audio, movie, pictures, etc.). Here is a chart that can provide some assistance. (view Chart)
